1935 On August 14, 1935, President Roosevelt signed the Social Security Act. On August 23 of that same year he appointed a three-man Social Security Board to administer the Act. November 1935, the Social Security Board adopted an identifier composed of 3 alphabetic characters representing geographic areas and 5 numeric characters. However, the Board made this decision without consulting other federal agencies. On December 17, 1935, the Board approved the 9-digit SSN format, a 9-digit number consisting of a 4-digit serial number, a 2-digit year of birth indicator, and a 3-digit number indicating the geographic area of registration;. The Board planned to use the year one attained age 65 as part of the SSN, thinking that once an individual attained age 65, the SSN would be reassigned to someone else.

1936 Originaly named Bureau of Old-Age Benefits - The unemployment compensation delegates objected to the use of digits to signify age because they thought a number of workers would falsify their age. As a result, a new scheme adopted by the Board on February 14 consisted of a 3-digit area code, a 2-digit month of birth, and a 4-digit serial number. Finally in June 2, 1936, the Board decided to keep the 9-digit scheme, although using the fourth and fifth digits to represent the month of birth was abandoned. Instead, those two digits would be a "group number" that could be used to maximize the utility of mechanical equipment and to verify the accuracy of punch cards. In 1936 the Social Security Board planned eventually to use area numbers to redistribute work to its 12 regional centers to serve workers in those areas. One or more area numbers were allocated to each state based on the anticipated number of SSN issuances in the state. until 1972, the area number represented the state in which the card was issued.
Generally, area numbers were assigned in ascending order beginning in the northeast and then moving westward. For the most part, people on the east coast have the lowest area numbers and those on the west coast have the highest area numbers. However, area numbers did not always reflect the worker's residence. During the initial registration in 1936 and 1937, businesses with branches throughout the country had employees return their SS-5 Application for Account Number to their national headquarters, so these SSNs carried the area number where the headquarters were located. As a result, the area numbers assigned to big cities, such as New York, Philadelphia, Boston, and Chicago, were used for workers in many other parts of the country (McKinley and Frase 1970, 373). Also, a worker could apply in person for a card in any Social Security office, and the area number would reflect that office's location, regardless of the worker's residence. In early June 1936, the Board decided to use a small paper card instead of metal. In October 1936, the Social Security Board selected a design submitted by Frederick E. Happel, an artist and photo engraver from Albany, NY, for the original Social Security card, for which Happel was paid $60. The Board placed an initial order for 26 million cards. In November 1936 the Board instead assigned headquarters staff to 56 Bureau field offices, covering all but one of the cities where the Post Office Department had set up its "central accounting" offices. 35 million SSNs were issued in the first 8 months of the registration effort. The publicity campaign and the Post Office Department's efforts resulted in over 22 million completed applications as of December 22, 1936, 28 days after the initial distribution of employee applications.

1937 Employers were to begin to deduct payroll taxes from worker's wages in January 1937. It would not be until May 1937 that a series of Supreme Court decisions cemented the constitutionality of the Social Security Act. Social Security benefit computations consider a worker's earnings from 1937.

1938 Initially, only employees working in covered employment and aged 64 or younger were eligible to obtain an SSN. However, almost from the start, state unemployment compensation agencies began using SSNs to identify workers, and some employers tended to prefer hiring individuals who already possessed an SSN (Social Security Board 1938, 53). So, after a few months the Bureau began issuing SSNs to anyone who applied. Sample studies in 1937 or early 1938 indicated that duplicate account numbers had been issued to not more than 3 or 4 percent of the applicants.

In 1938, a wallet manufacturer in Lockport, New York, the E.H. Ferree Company, decided to promote its product by showing how a Social Security card would fit into the wallet. The company vice president thought it would be clever to use a sample card with his secretary's actual SSN. The wallet was sold at Woolworth's13 and many other large department stores, and the SSN was widely distributed. Many purchasers adopted the SSN as their own—5,755 people were using it in the peak year 1943, and 12 were still using it as late as 1977. In all, SSA received 40,000 incorrect earnings reports under this SSN, which had to be reassigned laboriously to proper SSNs. SSA voided the much-used number and issued a new SSN to the secretary (SSA n.d. c).

1940 219-09-9999

1943 The expansion of SSN use began in 1943 with Executive Order (EO) 9397 requiring federal agencies to use the SSN for the purpose of identifying individuals in any new record systems

1946 In 1946 the Social Security Board was dissolved and replaced by the Social Security Administration, but Mr. Altmeyer's appointment as Commissioner assured continuity in our program leadership.

1950 Major benefit increases. Coverage extended to regularly employed farm and domestic workers, most non-farm self-employed, employees of nonprofit organizations and State and local employee groups not under a retirement system. Aid to Dependent Children (later called AFDC) benefits extended to needy parents.

1953 Department of Health, Education and Welfare created, with Oveta Culp Hobby as first Secretary and SSA as its largest agency.

1954 Disability program, freeze enacted. coverage: Farm and professional, self employed, clergymen on an elective basis, additonal groups of farm, domestic and governmental employees. 1955 SSA begins using computers.

1956 In 1956, the Social Security Administration installed the first large-scale computer to maintain records of earnings and to compute the benefits payable to workers and their families when they retire, become disabled, or die. 1958 In 1958 the Index was microfilmed. By 1958, the Flexoline (visible index) contained 160 million strips (each with a SSN) in 750 steel A-frame stands, and SSA was adding an average of 7 million new strips each year. In August 1958, SSA began converting the Flexoline index to microfilm and began capturing new SSN records on magnetic tape, using a special machine to then transcribe the code directly from magnetic tape into a readable microfilm record (Staruch 1978, 29–30).

This visual file which represented all names and name changes for account number card holders was maintained until 1958 when it was microfilmed. It occupied 23, 557 square feet of space on the seventh floor of the Candler Building. Benefits payable to dependents of disabled workers.

1959 In early 1958, we got the word. The entire Employee Index would be converted to microfilm and would be updated periodically by means of electronic data processing equipment. The conversion began in August, and by spring 1959, some 1.3 million panels of strips had been microfilmed.

1960
New SSA headquarters complex opened at Woodlawn, Md. First electronic data transmission system in field offices. Age limit removed on benefits to disabled workers.
1961 In 1961, issuance of original SSNs was centralized in Baltimore, but local offices continued to issue replacement cards. In 1961, the Federal Civil Service Commission established a numerical identification system for all Federal employees using the SSN as the identifying number.

1962 the Internal Revenue Service (IRS) decided to use the SSN as its taxpayer identification number (TIN) for individuals. According to U.S. Treasury regulations, any person who, after October 31, 1962, works as an employee for wages subject to Social Security taxes, Medicare taxes, or U.S. federal income tax withholdings is required to apply for "an account number"

1963 Sequence 700 through 728 was assigned to railroad workers until July 1963

1964 By 1964, the 200 million names in the National Employee Index were contained on 2,005 reels of magnetic tape that Bureau employees accessed by means of high-speed microfilm readers

1965 Self-employed doctors covered. Benefits to students age 18 to 22. Automatic recomputation of benefits based on earnings after retirement. Medicare program enacted with hospital and medical insurance. Social Security was originally a universal tax, but when Medicare was passed in 1965, objecting religious groups in existence prior to 1951 were allowed to opt out of the system.

1967 in 1967, the Defense Department adopted the SSN as its identification number for military personnel

1969 Black Lung benefit program for miners and families enacted. First SSA teleservice center opened in Washington, D.C. The U.S. Armed Forces has used the Social Security number as an identification number for Army and Air Force personnel since July 1, 1969

1970 SSA's first electronic system was not developed until 1970, when electronic verification of alleged numbers (EVAN) was introduced for internal use at field offices with Advanced Records System (ARS) submission

1971 In 1971, an SSA task force studied issues raised by nonprogram use of the SSN and proposed that SSA take a "cautious and conservative" position and do nothing to promote its use as an identifier.

1972 In March 1972, SSA began assigning SSNs and issuing cards exclusively from Baltimore via a computer-based system. It was also in 1972 that all applicants for federal benefits were required to have their own SSN. The area number is now assigned based on the ZIP code of the mailing address provided. In 1972, SSA created an electronic file, the Numerical Index File or Numident, to house the numerically-ordered master file of all assigned SSNs. the Navy and Marine Corps for their personnel since January 1, 1972

1973 In 1973, a report of the Department of Health, Education, and Welfare (now Health and Human Services) concluded that the adoption of a national identifier was not desirable, and that the SSN was not suitable for such a purpose

1974 SSN requests by law enforcement are not authorized by, and probably forbidden by, Section 7 of the Privacy Act of 1974. SSA has since introduced more rigorous verification procedures. On April 15, 1974, SSA implemented evidence requirements (age, identity, and citizenship/alien status) for applicants for an original SSN who are foreign-born, or are U.S.-born and age 18 or older. In 1974, SSA began assigning SSNs for nonwork purposes when such use of an SSN was authorized by law. Initially, the nonwork cards looked the same as cards issued to citizens and aliens authorized to work. SSI payments begin. The Coast Guard for their personnel since October 1, 1974

1975 May 15, 1978, SSA began requiring evidence of age, identity, and citizenship/alien status from all applicants for original SSNs, and evidence of identity for replacement Social Security cards. In addition, all foreign-born applicants for replacement cards were required to submit evidence of citizenship/alien status. In 1975, SSA's Bureau of Data Processing implemented the Full Registration and Identification System (FRIS) which expanded electronic screening capabilities and added electronic validation of SSNs (SSA 1990, 5).

1977 AFDC program transferred to SSA. Most Medicare responsibilities transferred to Health Care Financing Administration, but SSA field offices continue to help Medicare beneficiaries. New benefit computation method based on index.

1979 586 was divided among American Samoa, Guam, the Philippines, Americans employed abroad by American employers and, from 1975 to 1979, Indochinese refugees. In 1973, SSA began converting its legacy SS-5 records to the Numident electronic database, completing the conversion in 1979. There is one Numident record for each SSN ever assigned. in 1979 SSA created an electronic file called MULTX from a set of punch cards identifying multiple SSNs that was maintained by SSA's Office of Earnings Operations.

1980 DHEW becomes Department of Health and Human Services. SSA’s central operations Metro West complex opened in downtown Baltimore.

1981 The 1981 Omnibus Reconciliation Act (P.L. 97-123) added alteration and forgery of a Social Security card to the list of prohibited acts and also increased the penalties for such acts.

1982 In May 1982, SSA began annotating cards issued for nonwork purposes with the legend "not valid for employment."

1983 In 1983, SSA implemented the Enumeration Verification System (EVS) for verifying batches of SSNs; EVS employed a series of verification routines that are still in use. In 1983, section 205(c)(2)(G) of the Social Security Act was amended to require that the "social security card shall be made of bank-note paper and (to the maximum extent practicable) shall be a card which cannot be counterfeited" (P.L. 98-21). SSA worked with the Bureau of Engraving and Printing, the Secret Service, and the Federal Bureau of Investigation (FBI) to design a card that met these requirements. Changes were made to the card stock to make any attempt to erase or remove data easily detectable, and a form of printing with a raised effect that is difficult to replicate was used. Other features not obvious to the naked eye were also added.

1984 SSA implementation of an automated SSN screening system in 1984. In 1984, SSA created the Automated Enumeration Screening Process (AESP) to run every application for an original or replacement card through the Alphident (since converted to a database linked to the Numident file) to determine if the data on the incoming record match one or more existing records using a complex scoring system. If a potential match is indicated between an existing record and an application for an original SSN, the field office is alerted to resolve the matter. If no previously established record is found, an original SSN is issued to the applicant.

1985
1986 To claim a dependent on US taxes, a SSN is required to be listed if they are over the age of 5.
Under IRCA, all employers are required to verify the identity and employment eligibility of all employees hired after November, 1986, regardless of citizenship or national origin.


1987 In August 1987, SSA began a three-state pilot of the "Enumeration at Birth" (EAB) process in which the parent of a newborn can request an SSN as part of the state's birth registration process.

1988 To claim a dependent on US taxes, a SSN is required to be listed if they are over the age of 2.
In 1988, to prevent photocopy counterfeits, a security feature that displays as "void" when photocopied was added. Also in 1988, legislation increased the monetary penalties for SSN violations.

1990 To claim a dependent on US taxes, a SSN is required to be listed if they are over the age of 1.

1991 Additional states began to participate in EAB in July 1988. By the end of 1991, 45 states, the District of Columbia, Puerto Rico, and New York City had signed agreements. No microfilm SS-5 exists for a record created through the EAB process.

1992 Beginning in September 1992, SSA began issuing SSN cards with the legend "VALID FOR WORK ONLY WITH INS AUTHORIZATION" to noncitizens lawfully in the United States with temporary authority to work.

1994 To claim a dependent on US taxes, a SSN is required to be listed.
Courts may collect and use the SSNs of jurors for limited purposes per 42 U.S.C. § 405(c)(2)(E)
Widespread distribution of the SSN from driver records has been phased out with the 1994 adoption by Congress of a statute barring disclosure of "personal information" in drivers' licenses per 18 U.S.C.A. § 2725 (West Supp. 1997)
For any person to receive a federal education grant or loan, the student must furnish a SSN to the school for which they are applying.20 U.S.C. § 1091(a)(4)(B)

1995 Courts have consistently held that SSNs are to be withheld from public requesters of agency documents and therefore will not be released or will be redacted from released documents. e.g., Sheet Metal Workers Int'l Assn. v. United States Air Force, 63 F.3d 994(10th Cir. 1995)

1996 The 1996 federal welfare reforms contained a number of provisions authorizing, or sometimes requiring, the use of SSNs as a means of locating individuals who fail to pay their child support or alimony obligations 42 U.S.C. § 405(c)(2)(C)(ii) (1994) A major expansion of SSN use was provided in 1996 under welfare reform. Under welfare reform, to enhance child support enforcement, the SSN is to be recorded in the applications for professional licenses, driver's licenses, and marriage licenses; it must be placed in the records relating to a divorce decree, support order, or paternity determination or acknowledgment; and it must be recorded in the records relating to death and on the death certificate. When an individual is hired, an employer is required to report this event to the State's New Hire Registry. This "New Hire Registry" is part of the expanded Federal Parent Locator Service which enables States to find non-custodial parents by using the SSN.

1997 The use of SSNs as a means for identifying and tracking drivers is common in several states per e.g. N.J. ADM. CODE tit. 13, § 21-1.3(a) (1997)

1998 Almost 90 percent of the original Social Security cards issued in calendar year 1998 were processed through EAB. SSA introduced access to an automated system--called Systematic Alien Verification for Entitlements (SAVE) in a few offices several years ago, and by January 1997, SSA had SAVE in every SSA office

1999 (date unknown) Until recently SSA also maintained a separate SSN master file indexed by cardholder name. The Alpha Index File or Alphident enabled SSA employees to search by name if the number was unknown. In the process of modernizing SSA's master files, this file was converted to an IBM DB2 relational database linked to the Numident file. This database provides the same basic functionality as the Alphident. Like the Flexoline, the DB2 uses the Russell Soundex Coding System to group all surnames that have the same basic consonant sounds. When an individual's identifying information is available, an SSA employee can attempt to locate the SSN using a key based on the Soundex version of the last name, plus the first 4 characters of the first name, plus the century, year, and month of birth. SSA has designated this database a sensitive file and access is restricted. Using over 23 software routines to match names to SSNs which initially do not match SSA records-for TY1999, software matched 16 million (about 60 percent) of the initial mismatches.

2000 Effective with the September 1, 2000 benefit payments, the SSN printed on Social Security and Supplemental Security Income checks is no longer visible through the envelope window.

2002 Beginning in 2002, SSA began another pilot program referred to as Enumeration at Entry (EaE) that allows noncitizens admitted for permanent residence to obtain SSNs and Social Security cards based on data collected as part of the immigration process. Also in 2002, SSA began to open offices dedicated entirely to handling Social Security number business. Notifying employers of name/SSN errors. In 2002, we increased these "no match" letters from about 110,000 to 870,000. This is because we sent these letters to all employers who submitted W-2 forms with information that did not match our records instead of only to employers with relatively large number of mismatches. We will be reviewing the effectiveness of this change.

2003 This EaE pilot was expanded worldwide in early 2003. EaE is a joint effort involving the Department of State (DoS), DHS, and SSA. Under EaE, a person aged 18 or older can apply for both an immigrant visa and an SSN at a DoS office in his or her home country. If the visa is granted, then DoS transmits the identifying data from the person's visa/SSN application to DHS. If and when the person is physically admitted to the United States, DHS updates certain data, if necessary, and sends it to SSA for the SSN to be assigned and the card to be issued. All noncitizens enumerated through EaE receive an SSN in the special area number series 729 through 733

2004 In 2004, an estimated 42 million Medicare cards displayed the entire SSN, as did approximately 8 million Department of Defense insurance cards. In addition, although the Veterans Health Administration (VHA) discontinued the issuance of Veterans Identification Cards that display SSNs in March 2004, and has issued new cards that do not display SSNs, the VHA estimates that between 3 million and 4 million previously issued cards containing SSNs remain in circulation with veterans receiving VA health care services. Some universities still use the SSN as the students' identification number for a range of purposes, from administering loans to tracking grades, and may place it on students' identification cards, although usage for these purposes is declining. Additionally, to protect the privacy of recipients who are paid by check and help prevent identity theft, Treasury is taking steps to remove all personal identification numbers, including the SSN, on all check payments. The goal for completing the project is early 2004.

2004 As early as December 2004, IRTPA legislation prohibited states from displaying the SSN on driver's licenses or motor vehicle registrations

2005 The Intelligence Reform and Terrorism Prevention Act (IRTPA) of 2004 (Public Law (P.L.) 108-458) placed limits on the number of replacement Social Security cards an individual can receive. Beginning with cards issued on or after December 17, 2005, individuals may only receive three Social Security cards per year and 10 in a lifetime, with certain exceptions, such as correcting errors or name changes. To provide greater protection against the assignment of multiple SSNs to newborns, SSA enhanced its duplicate record detection routine in November 2005.

SSA modified MES to prevent the Agency from assigning two SSNs to the same child based on two EAB record submissions (in the same file) with different birth certificate numbers. We believe this change will reduce the number of multiple SSNs the Agency assigns to newborns. In fact, we believe SSA would not have assigned 499 of the multiple SSNs we identified in this review had it implemented this detection routine before our audit period. Although we commend SSA for enhancing its duplicate record detection routine, this system modification will not detect duplicate SSN applications that are processed via EAB and through a field office on the same day.

2006
The FTC estimates that as many as 9 million Americans have their identities stolen each year (FTC n.d.). Identity theft has reached such proportions that President George W. Bush issued Executive Order 13402 on May 10, 2006, establishing the President's Identity Theft Task Force.

2007 In a July 3, 2007, Federal Register notice, SSA solicited public comment on a proposal to change the way SSNs are assigned (SSA 2007b). Under this proposal, SSA would randomly assign SSNs from the remaining pool of available numbers, and the first three digits would no longer have any geographic significance. As of December 2007, SSA had identified and cross-referenced in the MULTX file over 4.7 million individuals with multiple SSNs, about 93 percent of whom have only two SSNs. Generally, those with multiple SSNs are the "very old" on the Numident. In 2007, the President's Identity Theft Task Force included among its SSN recommendations that "federal agencies should reduce the unnecessary use of SSNs, the most valuable commodity for an identity thief."

2009 As of January 20, 2009, SSA had issued 429,959 original and 114,714 replacement SSNs through the EaE process. SSA is currently working with DoS and DHS on expanding the EaE process to additional noncitizens. The E-Verify program (previously known as the Basic Pilot/Employment Eligibility Verification System), administered by DHS with SSA's support, can be used by employers to verify the SSN and confirm employment authorization under immigration law for newly hired employees. The employer enters the name, SSN, date of birth, and alleged citizenship/alien status from DHS Form I-9 Employment Eligibility Verification into the E-Verify system. E-Verify automatically matches this information against SSA's Numident, as well as DHS immigration records if the hire is a noncitizen. The employer receives an electronic response indicating either that employment is authorized or that the data do not match the information in SSA's or DHS' records. Use of the verification program is voluntary in most parts of the United States, but 13 states require certain employers to use it for new hires. The U.S. Citizenship and Immigration Services website indicates that 109,211 employers, representing close to 434,000 worksites, were registered to use E-Verify as of February 2009.

2010 RM 10205.505 Enumeration at Birth Process. Starting Jan-15-2010 Enumeration at birth (EAB) is a program that allows parents to complete applications for SSNs for their newborns as part of the hospital birth registration process. About 96% of SSNs for infants are assigned through the EAB process.

2011 06/24/11 Randomization of SSN in effect. Area numbers no longer denote region. Beginning in June 2011, DOD began removing the Social Security number from military identification cards. It is replaced by a unique DOD identification number, formerly known as the EDIPI.

  • The Social Security Board to cooperate with Federal uses of the number by issuing and verifying numbers for other Federal agencies
1961 The Civil Service Commission adopted the SSN as an official Federal employee identifier.

Internal Revenue Code Amendments (P.L. 87-397) required each taxpayer to furnish identifying number for tax reporting.
1962 The Internal Revenue Service adopted the SSN as its official taxpayer identification number.
1964 Treasury Department, via internal policy, required buyers of Series H savings bonds to provide their SSNs.
1965 Internal Revenue Amendments (P.L. 89-384) enacted Medicare. It became necessary for most individual s age 65 and older to have an SSN.
1966 The Veterans Administration began to use the SSN as the hospital admissions number and for patient record keeping.
1969 The Department of Defense adopted the SSN in lieu of the military service number for identifying Armed Forces personnel.
1970 Bank Records and Foreign Transactions Act (P.L. 91-508) required all banks, savings and loan associations, credit unions and brokers/dealers in securities to obtain the SSNs of all of their customers. Also, financial institutions were required to file a report with the IRS, including the SSN of the customer, for any transaction involving more than $10,000.
1971

SSA task force report published which proposed that SSA take a "cautious and conservative" position toward SSN use and do nothing to promote the use of the SSN as an identifier. The report recommended that SSA

  • Use mass SSN enumeration in schools as a long-range, cost-effective approach to tightening up the SSN system, and
  • Consider cooperating with specific health, education and welfare uses of the SSN by State, local, and other nonprofit organizations.
1972

Social Security Amendments of 1972 (P.L. 92-603):

  • Required SSA to issue SSNs to all legally admitted aliens at entry and of anyone receiving or applying for any benefit paid for by Federal funds;
  • Required SSA to obtain evidence to establish age, citizenship, or alien status and identity.
  • Authorized SSA to enumerate children at the time they first entered school.
1973 Buyers of series E savings bonds are required by the Treasury Department to provide their SSNs.

Report of the HEW Secretary's Advisory Committee on Automated Personal Data System concluded that the adoption of a universal identifier by this country was not desirable; also found that the SSN was not suitable for such a purpose as it does not meet the criteria of a universal identifier that distinguishes a person from all others.
1974

Privacy Act (P.L. 93-579) enacted effective September 27, 1975 to limit governmental use of the SSN:

  • Provided that no State or local government agency may withhold a benefit from a person simply because the individual refuses to furnish his or her SSN.
  • Required that Federal, State and local agencies which request an individual to disclose his/her SSN inform the individual if disclosure was mandatory or voluntary. (This was the first mention of SSN use by local governments.)
1975

Social Services Amendments of 1974 (P.L. 93-647) provided that:

  • disclosure of an individual's SSN is a condition of eligibility for AFDC benefits; and
  • Office of Child Support enforcement Parent Locator Service may require disclosure of limited information (including SSN and whereabouts) contained in SSA records.
1976

Tax Reform Act of 1976 (P.L. 94-455) included the following amendments to the Social Security Act:

  • To allow use by the States of the SSN in the administration of any tax, general public assistance, driver's license or motor vehicle registration law within their jurisdiction and to authorize the States to require individuals affected by such laws to furnish their SSNs to the States;
  • To make misuse of the SSN for any purpose a violation of the Social Security Act;
  • To make, under federal law, unlawful disclosure or compelling disclosure of the SSN of any person a felony, punishable by fine and/or imprisonment.
  • To amend section 6109 of the Internal Revenue Code to provide that the SSN be used as the tax identification number (TIN) for all tax purposes. While the Treasury Department had been using the SSN as the TIN by regulation since 1962, this law codified that requirement.

Federal Advisory Committee on False Identification recommended that penalties for misuse should be increased and evidence requirements tightened; rejected the idea of national identifier and did not even consider the SSN for such a purpose.

1977

Food Stamp Act of 1977 (P.L. 96-58) required disclosure of SSNs of all household members as a condition of eligibility for participation in the food stamp program.

Privacy Protection Study Commission recommended that:

  • No steps be taken towards developing standard, universal label for individuals until safeguards and policies regarding permissible uses and disclosures were proven effective; and
  • Executive Order 9397 be amended so that Federal agencies could no longer use it as legal authority to require disclosure of an individual's SSN. (No action taken.)

The Carter Administration proposed that the Social Security card be one of the authorized documents by which an employer could be assured that a job applicant could work in this country but also stated that the SSN card should not become a national identity document.

1978 SSA required evidence of age, citizenship, and identity of all SSN applicants.
1981

Reagan Administration stated that it "is explicitly opposed to the creation of a national identity card" but recognized the need for a means for employers to comply with the employer sanctions provisions of its immigration reform legislation.

Omnibus Budget Reconciliation Act of 1981 (P.L. 97-35) required the disclosure of the SSNs of all adult members in the household of children applying to the school lunch program.

Social Security Benefits Act (P.L. 97-123)

  • Section 4 added alteration and forgery of a Social Security card to the list of prohibited acts and increased the penalties for such acts.
  • Section 6 required any Federal, State or local government agency to furnish the name and SSN of prisoners convicted of a felony to the Secretary of HHS, to enforce suspension of disability benefits to certain imprisoned felons.

Department of Defense Authorization Act (P.L. 97-86) required disclosure of the SSNs to the Selective Service System of all individuals required to register for the draft.

1982 Debt Collection Act (P.L. 97-365) required that all applicants for loans under any Federal loan program furnish their SSNs to the agency supplying the loan.

All Social Security cards issued to legal aliens not authorized to work within the United States were annotated "NOT VALID FOR EMPLOYMENT" beginning in May.
1983 The Social Security Amendments of 1983 (P.L. 98-21) required that new and replacement Social Security cards issued after October 30 be made of banknote paper and (to the maximum extent practicable) not be subject to counterfeiting.

The Interest and Dividend Tax Compliance Act (P.L. 98-67) requires SSNs for all interest-bearing accounts and provides a penalty of $50 for all individuals who fail to furnish a correct TIN (usually the SSN).
1984

Deficit Reduction Act of 1984 (P.L. 98-369)

  • Amended the Social Security Act to establish an income and eligibility verification system involving State agencies administering the AFDC, Medicaid, unemployment compensation, the food stamp programs, and State programs under a plan approved under title I, X, XIV, or XVI of the Act. States were permitted to require the SSN as a condition of eligibility for benefits under any of these programs.
  • Amended Section 6050I of the IRC to require that persons engaged in a trade or business file a report (including SSNs) with the IRS for cash transactions over $10,000.
  • Amended Section 215 of the IRC to authorize the Secretary of HHS to publish regulations that require a spouse paying alimony to furnish IRS with the taxpayer identification number (i.e., the SSN) of the spouse receiving alimony payments.
1986

The Immigration Reform and Control Act of 1986 (P.L. 99-603):

  • Required the Comptroller General to investigate technological changes that could reduce the potential for counterfeiting Social Security cards;
  • Provides that the Social Security card may be used to establish the eligibility of a prospective employee for employment; and
  • Required the Secretary of HHS to undertake a study of the feasibility and costs of establishing an SSN verification system

Tax Reform Act of 1986 (P.L. 99-514) required individuals filing a tax return due after December 31, 1987, to include the taxpayer identification number--usually the SSN--of each dependent age 5 or older.

Commercial Motor Vehicle Safety Act of 1986 (P.L. 99-750) authorized the Secretary of Transportation to require the use of the SSN on commercial motor vehicle operators' licenses.

Higher Education Amendments of 1986 (P.L. 99-498) required that student loan applicants submit their SSN as a condition of eligibility.

1987 SSA initiated a demonstration project on August 17 in the State of New Mexico enabling parents to obtain Social Security numbers for their newborn infants automatically when the infant's birth was registered by the State. The program was expanded nationwide in 1989. Currently, all 50 States participate in the program, as well as New York City, Washington, D.C., and Puerto Rico.
1988

Housing and Community Development Act of 1987 (P.L. 100-242) authorized the Secretary of HUD to require disclosure of a person's SSN as a condition of eligibility for any HUD program.

The Family Support Act of 1988 (P.L. 100-485):

  • Section 125 required, beginning November 1, 1990, a State to obtain the SSNs of the parents when issuing a birth certificate.
  • Section 704(a) required individuals filing a tax return due after December 31, 1989, to include the taxpayer identification number--usually the SSN--of each dependent age 2 or older.

The Technical and Miscellaneous Revenue Act of 1988 (P.L. 100-647):

  • Authorized a State and/or any blood donation facility to use SSNs to identify blood donors (205(c)(2)(F)).
  • Required that all title II beneficiaries either have or have applied for an SSN in order to receive benefits. This provision became effective with dates of initial entitlement of June 1989 or later. Beneficiaries who refused enumeration were entitled but placed in suspense.

Anti-Drug Abuse Act of 1988 (P.L. 100-690) deleted the $5,000 and $25,000 upper limits on fines that can be imposed for violations of section 208 of the Social Security Act. The general limit of $250,000 for felonies in the U.S. Code now applied to SSN violations under section 208 of the Social Security Act. Also, penalties for misuse of SSNs apply as well in cases where the number is referred to by any other name (e.g., taxpayer identification number (TIN)).

1989 Omnibus Budget Reconciliation Act of 1989 (P.L. 101-239) required that the National Student Loan Data System include, among other things, the names and SSNs of borrowers.

Child Nutrition and WIC Reauthorization Act of 1989 (P.L. 101-147) requires the member of the household who applies for the school lunch program to provide the SSN of the parent of the child for whom the application is made.
1990

Omnibus Budget Reconciliation Act of 1990 (P.L. 101-508):

  • Section 7201 (Computer Matching and Privacy Protection Amendments of 1990) provided that no adverse action may be taken against an individual receiving benefits as a result of a matching program without verification of the information or notification of the individual regarding the findings with time to contest.
  • Section 8053, required an SSN for eligibility for benefits from the Department of Veterans Affairs (DVA).
  • Section 11112, required that individuals filing a tax return due after December 31, 1991, include the taxpayer identification number--usually the SSN--of each dependent age 1 or older.

Food and Agricultural Resources Act of 1990 (P.L. 101-624), Section 1735:

  • Required an SSN for the officers of food and retail stores that redeem Food Stamps.
  • Provided that SSNs maintained as a result of any law enacted on or after October 1, 1990, will be confidential and may not be disclosed.
1994

Social Security Independence and Program Improvements Act of 1994 (P.L. 103-296):

  • Section 304, authorized the use of the SSN for jury selection.
  • Section 314, authorized cross-matching of SSNs and Employer Identification Numbers maintained by the Department of Agriculture with other Federal agencies for the purpose of investigating both food stamp fraud and violations of other Federal laws.
  • Section 318, authorized the use of the SSN by the Department of Labor in administration of Federal workers' compensation laws.
1996

Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (P.L. 104-193) (Welfare Reform ):

  • Section 111 required the Commissioner of Social Security to develop and submit to Congress a prototype of a counterfeit-resistant Social Security card that: is made of durable, tamper-resistant material (e.g., plastic); employs technologies that provide security features (e.g., magnetic stripe); and provides individuals with reliable proof of citizenship or legal resident alien status.
  • Section 111 also required the Commissioner of Social Security to study and report to Congress on different methods of improving the Social Security card application process, including evaluation of the cost and workload implications of issuing a counterfeit-resistant Social Security card for all individuals and evaluation of the feasibility and cost implications of imposing a user fee for replacement cards.
  • Section 316 required HHS to transmit to SSA, for verification purposes, certain information about individuals and employers maintained under the Federal Parent Locator Service in an automated directory. SSA is required to verify the accuracy of, correct, or supply to the extent possible, and report to HHS the name, SSN, and birth date of individuals and the employer identification number of employers. SSA is to be reimbursed by HHS for the cost of this verification service. This section also required all Federal agencies (including SSA) to report quarterly the name and SSN of each employee and the wages paid to the employee during the previous quarter.
  • Section 317 provided that State child support enforcement procedures require the SSN of any applicant for a professional license, commercial driver's license, occupational license, or marriage license be recorded on the application. The SSN of any person subject to a divorce decree, support order, or paternity determination or acknowledgement would have to be placed in the pertinent records. SSNs are required on death certificates.
  • Section 451 provided that, in order to be eligible for the Earned Income Tax Credit, an individual must include on his or her tax return an SSN which was not assigned solely for non-work purposes.

Federal agencies are precluded from accepting as proof of identity, documents which do not meet the regulatory standards.
  • Section 657 provided for the development of a prototype Social Security card. The requirements were the same as in Section 111 of the Welfare reform legislation (described above) with the exception that the Comptroller General is also to study and report to Congress on different methods of improving the Social Security card application process.

1997 Taxpayer Relief Act of 1997 (P.L. 105-34)

  • Section 1090 required an applicant for an SSN under age 18 to provide evidence of his or her parents' names and SSNs in addition to required evidence of age, identity, and citizenship.

The Omnibus Consolidated and Emergency Supplemental Appropriations Act of 1999 (P.L. 105-277)

  • Section 362 provided that no funds appropriated for the Department of Transportation (DOT) may be used to issue the final regulations required by section 656(b) of the Illegal Immigration Reform and Responsibility Act of 1996. Section 656(b) prohibited Federal agencies from accepting as proof of identification a drivers license that do not meet standards promulgated by the DOT. The standards include a document that contains a Social Security number that can be read electronically or visually and is in a form that includes security features to limit tampering and counterfeiting.

Identity Theft and Assumption Deterrence Act of 1998 (P.L. 105-318)

  • Makes identity theft (transferring or using another person's means of identification) a crime, subject to penalties.
  • Defines "means of identification" to include name, social security number, date of birth, official State or government issued driver's license or identification number, alien registration number, government passport number, and employer or taxpayer identification number; and
  • Establishes the Federal Trade Commission as a clearinghouse to receive complaints, provide informational materials to victims, and refer complaints to appropriate entities, which may include credit bureaus or law enforcement agencies.

Vice President announced new policy to allow victims of domestic violence to change their SSN without proof that the abuser had misused their SSN.


P.L. 105-379 11/12/98 amended the Food Stamp Act, effective June 1, 2000, to require:

  • Each State agency that administers the food stamp program to enter into a cooperative arrangement with the Commissioner of Social Security under section 205(r) of the Social Security Act to verify whether food stamp recipients are deceased to ensure that benefits are not issued to deceased individuals.
  • The Secretary of Agriculture is to report to Congress and to the Secretary of the Treasury on the progress and effectiveness of the cooperative arrangements established.
1999

October 9, 1999 P.L. 106-69, Department of Transportation (DOT) and Related Agencies Appropriations Act, 2000:

  • Section 355 repealed section 656(b) of the Illegal Immigration Reform and Responsibility Act of 1996.


December 14, 1999 P.L. 106-169, the Foster Care Independence Act of 1999:

  • Section 209 deems SSA’s privacy standards meet all State privacy standards for purposes of sharing data.
2000

Social Security Number Confidentiality Act of 2000 (P.L. 106-433):

  • Section 2 requires the Treasury Secretary to ensure that SSNs are not visible on or through unopened mailings of government checks or other drafts beginning 11/06/03.
2001

DOT and Related Agencies Appropriations Act of 2002 (P.L. 107-87)

  • Section 311 provides that no recipient of funds via this Act shall disseminate information, including SSNs, obtained by a State DMV except as authorized by law; Effective 12/18/01.
2002

2002 Supplemental Appropriations Act for Further Recovery From and Response to Terrorist Attacks on the United States (P.L. 107-206)

  • Title I, Chapter 11 provides funds to the Department of Transportation to be used for purposes of coordinating driver’s license registration and SSN verification.

Help America Vote Act of 2002 (P.L. 107-252)

  • Section 244 requires the newly established Election Assistance Commission to submit a report, prepared in consultation with the Commissioner of SSA, not later than 18 months after section 303(a)(5) takes effect. This report will discuss the feasibility and advisability of using SSNs or other information compiled by SSA to establish voter registration or other election law eligibility or identification requirements; the report shall address the matching of relevant information specific to an individual voter, the impact of such use on national security issues, and whether adequate safeguards or waiver procedures exist to protect the privacy of an individual voter.
  • Section 303 requires each State to create a computerized voter registration list, using a unique identifier developed by the state. It also amends the Social Security Act to require the Commissioner to enter into agreements upon the request of the official responsible for a state driver’s license agency to verify the accuracy of certain information regarding applicants (including whether the name, date of birth and SSN of an individual provided to the COSS match the information in SSA’s records and whether such individual is shown as deceased on SSA’s records) for voter registration in Federal elections; effective 01/01/04 except where a waiver applies.
2003

The Basic Pilot Program Extension and Expansion Act of 2003 (P.L. 108-156)

  • Section 2 extends the operation of the pilot programs for an additional 5 years (to a total of 11 years).
  • Section 3(a) expands the operation of the pilot programs to all 50 States not later than 12/01/04; provides that employers in all States must be able to participate in the pilot program.
2004

The Intelligence Reform and Terrorism Prevention Act of 2004 (P.L. 108-458)

Section 7213:

  • Not later than one year after the date of enactment, requires the Commissioner of Social Security to:

-- Restrict the issuance of multiple replacement Social Security cards to any individual to 3 per year and 10 for the life of the individual. The Commissioner may allow for reasonable exceptions from these limits on a case-by-case basis in compelling circumstances.

-- Establish minimum standards for the verification of documents or records submitted by an individual to establish eligibility for an original or replacement Social Security card, other than for enumeration at birth (EAB).

-- Require independent verification of any birth record submitted by an individual to establish eligibility for a Social Security account number. SSNs assigned through the EAB process are excluded from this requirement. The Commissioner may allow for reasonable exceptions from independent verification on a case-by-case basis in compelling circumstances.
  • Notwithstanding section 205(r) of the Social Security Act and any agreement entered into thereunder, requires the Commissioner to add death indicators to the Social Security number verification systems used by employers and State agencies issuing driver’s licenses and identity cards. The Commissioner may also add death indicators to other verification routines as determined appropriate. The death indicators must be added no later than 18 months after enactment.
  • Requires the Commissioner to add fraud indicators to the Social Security number verification systems used by employers and State agencies issuing drivers' licenses and identity cards. The Commissioner may also add fraud indicators to other verification routines as determined appropriate. The fraud indicators must be added no later than 36 months after enactment.
  • Requires SSA, in consultation with the Department of Homeland Security, to form an interagency task force for the purpose of further improving the security of Social Security cards and numbers. Not later than 18 months after the date of enactment, the task force must establish security requirements, including standards: for safeguarding cards from counterfeiting, tampering, alteration, and theft; for verifying documents submitted for the issuance of replacement cards; and actions towards increasing enforcement against the fraudulent use or issuance of Social Security numbers and cards. The Commissioner is also required to provide for the implementation of these security requirements.
  • Requires the Commissioner to make improvements to the EAB application process as soon as practicable after the date of enactment. These improvements shall be designed to prevent the assignment of Social Security account numbers to unnamed children, the issuance of more than one Social Security number to the same child, and other opportunities for fraudulently obtaining a Social Security number. Not later than one year after enactment, the Commissioner must provide a report to Congress specifying the extent to which these improvements were made.
  • Requires the Commissioner to conduct a study to determine options for ensuring the integrity of the EAB process, including methods to reconcile hospital birth records with birth registrations submitted to State and local agencies and information provided to SSA. Not later than 18 months after enactment, the Commissioner must report to the House Committee on Ways and Means and the Senate Committee on Finance on the results of the EAB study, including recommendations for legislative changes as deemed necessary by the Commissioner.

Section 7214:

  • Prohibits Federal, State, and local governments from displaying SSNs, or any derivative thereof, on drivers' licenses, motor vehicle registrations, or other identification documents issued by State departments of motor vehicles.

The Real ID Act, (P.L. 109-13)

Establishes State driver’s license and identification security standards which requires States to confirm with Social Security a SSN for issuance of a drivers license or identity card
